Product Safety Infringement Notices

Product Safety Officers can issue infringement notices for breaching product safety regulations. The table below outlines the range of infringements and their penalties.

 Fair Trading Act 1987    

s 51(1)  Supplying goods which do not comply with a product safety standard regulation.  $1,000
s 51(2)  Supplying a component part in contravention of a product safety standard regulation.   $1,000
s 52(1)  Supplying goods contravening a banning order under s23Q or 23R of the Consumer Affairs Act 1971.  $1,000
s 54 (9)  Failing to give a notice to a person outside WA supplied with recalled goods.  $500
s 54 (10)  Failing to give a notice to the Commissioner in regards to recalled goods.  $500
s 60 (1) 
Supplying goods which do not comply with a product information standard regulation.  $1,000
S 60 (2)  Supplying a component part in contravention of a product information standard regulation.  $1,000
s 65(1) 
Supplying goods which do not comply with a product quality standard regulation.  $1,000
s 67(1)  Supplying goods which do not comply with a packaging standard.  $1,000

 Consumer Affairs Act 1971    

s 23S  Supplying goods in contravention of s23Q or 23R order.  $1,000
s 23V (1), 23W  Supplying goods which do not comply with prescribed safety requirements.   $1,000
s 23V (2), 23W  Supplying a component part which does not comply with requirements of the regulations.  $1,000
